Planning Board Members Present: John Abraham (V-Alt) Joe Barwinczok (T), Don Bowden (T), Amy Chirco (V),Chet Dziergas (V), Mark Farrell (V&T), Mike Glowacki (V-Alt), Derek Ostrowski (T-Alt), Jim Scanlon (T), Jim Sullivan (V)

 

Absent:  none

 

Also Present: Town Engineer, Tom Piascik; Lynette Murray, Planning Board Clerk.

1. OPENING:

The meeting was called to order at 7:00 PM by Amy Chirco who chaired the meeting. Member Chirco also led the Pledge of Allegiance and asked if there were any questions, additions, deletions to the minutes from the December 16, 2010 meeting. John Abraham

 

Member Mark Farrell motioned to accept minutes as written. Member Dziergas seconded the motion. No discussion.

Vote:  8 ayes; 0 nays, Carried.

1. CAMPBELL: Continuation of the Preliminary Plat Stage; delay due to appointed legal representation of Campbell Estate after Mr. Thomas Campbell's passing.

 

TWO (Parent Parcel + 1 Lot) LOT MINOR SUBDIVISION

8332 State Route 34-Tax Map #89.00-1-35.1; 34.04 acres; A/R Dist.

 

Ruth Harding and Sandy Kalbach approached the board. (7:02 pm)

 

Legal Representation was presented to the board for Sandra Kalbach of Key Bank to act as Executor for the Campbell Estate (original in file).

 

-Planning Board Members reviewed revised map (date stamped 12/29/10) for updated requirements from 7/2010 PB meeting (Lots initially labeled A and B should be labeled 1 and 2 respectively; 2 and 3 should be replaced with property owner names).

 

-Cayuga County Planning Board deemed no inter-municipal issues with this project.

Paperwork submitted to County Planning Dept. on 1/10/11. Response received 1/26/11 (facsimile copy in file).

 

 

-Motion was made for Public Hearing by Member Don Bowden seconded by Jim Sullivan for the 2/23/11 meeting.

VOTE: 9 ayes 0 nays Carried.

 

Follow up letter will advise a Mylar map will need to be submitted prior to 2/9/11 for the 2/23/11 meeting

 

Ruth Harding and Sandy Kalbach left meeting 7:09pm

 

 

2.PETRUS:  Public Hearing Continued.

 

TWO (Parent Parcel + 1 Lot) LOT MINOR SUBDIVISION

Vacant Off State Route 31 - Tax Map # 82.00-1-9.3; 86.9 acres; A/R Dist.,

Residential Dist. and Spec Dev. Dist.)

 

7:07pm

 

-No one present for thus subdivision.

-Revised maps not submitted. Planning Board Members honored the applicants request to be removed from the 1/26/11 Agenda, pursuant to a via phone messages date 1/13/11 and 1/18/11 (notes in file)

 

Motion was made to carry out applicants request to be removed from agenda as well as close the public hearing Member Scanlon second by Member Dziergas.

VOTE: 9 ayes 0 nays Carried

 

3.BARNES PUBLIC HEARING:  

           

TWO (Parent Parcel + 1 lot) LOT MINOR SUBDIVISION

2959 State Route 31 - Tax Map # 77.00-2-30.1- Special Development District

 

Nancy Barnes approached the Board 7:08pm

 

-Board members reviewed map. No further amendments.

-Received correspondence from NYS Department of Transportation expressing there was no concern with thus project (in file for review).

-Chairperson Chirco opened the Public Hearing at 7:09 PM. Chair Chirco asked if there were any questions, concerns or comments of anyone at the public hearing. No one responded with any.

Member Sullivan motioned to approve and close the public hearing. Member Dziergas seconded the motion.

Vote: 9 ayes, 0 nays. Carried

 

Public hearing closed 7:11pm

 

-The Planning Board determined that the action would have a Negative Declaration which means there will be no adverse environmental impacts in completing this subdivision.

 

Motion was made to deem the project Negative (No Environmental Impact) SEQR on thus project by Member Dziergas seconded by Member Sullivan.

Vote: 9 ayes, 0 nays. Carried

 

Motion was made from board Member Sullivan to accept and finalize the project and Member Dziergas second.

VOTE: 9 ayes, 0 nays. Carried

 

Chair Chirco communicated that the maps will be signed and ready for submission to the county 1/27/11 after 12:00 pm at the Town Office. Follow up letter will be sent to complete the process which communicates that the subdivision is approved and that the maps must be filed with Cayuga County within its deadline.

 

4 .CHRISTOPHER/DELLOSTRITTO PUBLIC HEARING:

                       

TWO LOT SUBDIVISION

Vacant/Off Weedsport-Sennett Rd-Tax Map #s: 89.00-1-31.461, --31.462, --31.463, --31.464; A/R Dist.

 

James DelloStritto, Brian Christopher and another member approached the Board

 

-Review revised maps no further action requested from board members.

-Cayuga County Planning Board deemed no inter-municipal issues with thus project but did add to remind the developer and Town that if one or more acres of soil are disturbed in development; the developer will need to apply for a State Pollutant Discharge Elimination System (SPDES) permit from NYS Department of Environmental Conservation. Paperwork submitted to County Planning Dept. on 1/10/11. Response received 1/26/11.

-Chairperson Chirco opened the Public Hearing at 7:14 PM. Chair Chirco asked if there were any questions, concerns or comments of anyone at the public hearing; Neighboring Property Owners Cassie Lee and Don Arliss approached the table to question the proposed plan of the subdivision and intent on the development; concern about the development was addressed to the applicants and their intentions to add several structures within a period a several years.

 

Member Dziergas .motioned to close the Public Hearing and Member Bowden second.

VOTE: 9 ayes, 0 nays Carried.

 

7:20 pm Public Hearing closed

Vacant parcel split by Putnam Rd; Tax Map #77.00-2-27.112; 54.5 acres; Resid and A/R Dist.

Planning Board honored the applicants request to be removed from the 1/26/11 Agenda pursuant to a via phone messages dated 1/25/11 and fax notice from Attorney Dale Yates (notes in file)

 

Motion made to carry out Pacholyk request to be removed from agenda Pacholyk advised that there will be future communications to the planning board regarding the subdivision.

Member Scanlon motioned to accept and Member Dziergas second.

VOTE:  9 ayes 0 nays Carrie

 

6. PACHOLYK PUBLIC HEARING:

                       

THREE LOT SUBDIVISION

Vacant/Off Clinton Rd-Tax Map #77.00-2-41.1; 90 acres; A/R Dist.

 

Planning Board honored the applicants request to be removed from the 1/26/11 Agenda pursuant to a via phone messages dated 1/25/11 and fax notice from Attorney Dale Yates (notes in file)

 

Motion made to carry out Pacholyk request to be removed from agenda Pacholyk advised that there will be future communications to the planning board regarding the subdivision.

Member Scanlon motioned to accept and Member Dziergas second.

VOTE:  9 ayes 0 nays Carried

 

Board was approached by the following with the intent of a public hearing:

Greg Weller

Jeanette O'Conner

 

To question the right of way access as well and the use of utilizing the county trail to access property Planning Board members advised that was a legal matter.

 

Allen Weller, Robert Whitcomb, Greg Weller and Jeanette O'Connor left meeting at 7:35pm

 

7. SPAULDING INFORMATIONAL MEETING:

                       

TWO LOT SUBDIVISION

8740 Pierce Rd; Tax Map #84.00-2-22; 16.10 Acres; A/R Dist.

 

Denise L. Spalding approached the board (7:35pm) to discuss the proposed project and to create an  approximate 2 acre subdivision from the main parcel.

           

-Planning Board Members reviewed initial (preliminary) map & plans submitted.

-The planning board suggested that the mother lot (parent parcel) should be labeled # 1

 and the proposed parcel to be subdivided should be labeled as # 2.

-Planning Board Members also advised the revised map will need to include neighboring

 properties any existing structures, utilities (power lines, fire hydrants, water line).

-The board recommended ensuring the 200 feet road frontage requirement is included in the plans

-Revised map as well as the application fee of $75.00 will need to be turned into the town by 2/9/11 To ensure to be included in the agenda for the 2/26/11 meeting

 

Motion to accept the proposed subdivision from Member Scanlon second by Member Dziergas,

VOTE: 9 ayes 0 nayes Carried

 

Denise L. Spalding left the meeting 7:50 pm

 

8. Correspondence/Other Items: received directed to individual members was given at the beginning of the meeting with agenda and name plate.

 

Updates to the Blue Book (Code Book) were distributed to Planning Board Members with Code Books.

 

Discussions amongst Board Members to include a copy of the tax map of a proposed subdivision.

 

9. CLOSING

 

Member Farell motioned to close the meeting.  Member Sullivan seconded the motion. 

VOTE: 9ayes; 0 nays.  Carried

 

The meeting ended at 8:12 pm.
